Hi everyone,
I need your help answering this question:

When there is a conflict between state and federal law, which law prevails?

A. Federal law
B. State law
C. More stringent law
D. Federal law when dealing with controlled substances
E. None of the above

I thought the answer is ( C ) but the book says ( A ), really confused.

The answer should be " which ever law is more strident should prevail', at least that is demonstrated in most cases.

federal law supercedes state law. State law supercedes local law. I've never heard that the more strict law prevails..
 
Of course federal law supersedes state law and so forth but the answer to that is definitely C.

Lets say federal law says you keep rx records for 2 years and state law says keep rx records for 5 years. Which do you follow? You obviously keep them for 5 years.

Common sense.
