GA Residency Question

All you Georgians!!

I am wondering about residency in GA. My girlfriend is applying this coming year, but is thinking about working outside of GA for the entire year. She will obviously pay taxes in whatever state she is in, but will that cause her to lose GA residency? I need info from Georgians. I am a VA resident, and have worked in NC for the entire year while applying, and still, I asked and each school said that I maintained my VA residency by keeping my voter, driver's liscence and car registration in VA. So what about GA? Please reply with any info

I know that MCG and Mercer are pretty strict about what defines residency in GA. They both ask what state your last income tax form was filed in, what state issued your driver's lisence, and what state you are registered to vote. MCG requires you to list every address at which you lived over the past 5 yrs. Mercer doesn't accept anyone that isn't a GA resident at time of application, while MCG accepts a very small percentage of out of state (Maybe 2%??). She will probably have to get a notorized certificate of GA residency signed by the judge in the county she lives in, either at the time of application or before enrollment. Emory and Morehouse are less strict in terms of accepting only GA residents, but I don't know if having residency would increase fin. aid to those schools. She would probably need to submit the same proof as listed above for state aid. Is she going to be out of GA while she is applying?

She is looking at jobs in GA and out of GA and wondering if she should even consider working outside of GA. She will be working while applying this summer and next year, and definitely wants to maintain her residency. That notorized certificate is new info for us. What is that all about? Mercer and Morehouse I know require the certificate thing, but I'm not sure about Emory and MCG (or schools in other states for that matter). I don't really understand why they require it, since they ask for so many other things that should be proof enough. I guess if it means a big difference in tuition, they want to do all they can to make sure you aren't able to claim residency when you shouldn't. But it didn't really mean much in my case...the judge didn't even ask for proof (I am a GA resident anyway, but he just trusted me I guess), but at least the schools got what they wanted.

In general, it is illegal for someone not in school to live somewhere for any significant time and not reregister their car and get a new driver's license (Active duty military are a big exception). You can actually get a ticket for driving without a license and driving an unregistered motor vehicle. In my former life as a lawyer I saw two cases prosecuted for that very thing. What are you doing about state income tax? Paying in both states?

I think it is great that you the schools still consider you a Virginian. Virginia is very tough on those who try to get instate tuition. It's hard to keep you Virginianity <img border="0" title="" alt="[Eek!]" src="eek.gif" />

I'll see if I can find some regulations on what constitutes residency and domicile in Georgia -- good luck.
