Navy HPSP AT Pay Question

I sent an e-mail to the folks at the Navy HPSP office but I haven't gotten a response so I'll ask the folks here.

I have five years and change prior comissioned service and got out as an O-3. I sent in my DD214 to get credit for prior service. Now I'm on AT orders and got paid as an O-1 over 4. Is this right or should I have been paid as an O-3 over 4?

This is actually a very good question. I was about to state with certainty that the O-1 over 4 was correct, but after checking a couple of references, I am not entirely positive.

From page 49 of the Navy HPSP Handbook:
"Base Pay. You will receive the basic pay of an Ensign (01) with less than 2 years of service. Students who have established prior service entitlements will be paid at a higher rate (see the military pay scale for more details). Base pay is taxable."

This leads me to believe that we would just check the pay tables for the appropriate years in service...but it is not 100% clear.

From page 1 of the HPSP Service Agreement:
" I will: a. Be commissioned in the reserve component of the Navy (Designator 1975, 1985, or 1995) in the rank and grade of Ensign (O-1). As a member of AFHPSP, I will be required to serve 45-day active duty tours in the pay grade of O-1 unless I am eligible to hold a higher grade under another law. When on active duty, I will be subject to the Uniformed Code of Military Justice and to Navy Uniform Regulations."

Show me the other law, and I'll show you the money!
 
What actually led me to believe that I should be paid as an O-3 was my understanding that the same change that allowed prior commissioned service folks at USUHS to collect the basepay of their previous rank also allowed HPSP folks to collect basepay of their previous rank while on AT (but not during the rest of the year when they get their regular stipend).

Even if that is the case, from what I understand, although the DOD has approved this change, this does not necessarily mean that each of the departments has budgeted for it or implemented it.
 
I sent them an email today asking the same question. I was under the same understanding about the pay. Could simply be that this is a "new" provision of the 2008 NDAA and everyone is not up to speed yet. I'll let you know what I hear back.

As long as the headshed has a copy of your DD214, you should receive base pay at the O-3 over 4 level and BAH/BAS at the O-1 level. It is likely that the computer systems will not recognize the changes from NDAA 2008 and there will have to be a manual adjustment made after your AT is completed.

FWIW, I've been on consecutive ADTs since 1 Sep but I am still getting paid at an O-1 over 3 rate (in spite of being prior service O-4). Was the whole 2008 NDAA bit about getting paid at your prior rank during ADTs misinterpreted? Is DFAS just clueless? Who do I contact to get a definitive answer?
 
I did actually get the additional pay owed to me thirty days after I completed my active duty, but only after I contacted the HPSP folks in Bethesda to aak what I needed to do to see the cash. I still (3months after completing AD) haven't seen the BAH adjustment though.
 
I remember once it took me 7 months to get my reimbursement for lodging at my annual AT. Unfortunately, this stuff seems par for the course.

HPSP correspondence did improve significantly with the change in leadership (i.e. when CDR McLean took over).
 
If any of you are able to get your 0-3 pay, please let the rest of us know how you accomplished this task. It took me two and a half months just to get my HPSP stipend and I am guessing that when I do my ADT next year, I will be paid as an 0-1 and have to go through some sort of fight for the 0-3 pay that I should receive.
