OP, this isn't as simple as answering a few yes or no questions. Counties, cities, states, federal, you name it, all these courts and jurisdictions differ. Even the severity of the charge or what the prosecutor decides to do can vary on if they had a good breakfast or not. This is why you need a lawyer who specializes in the area of law where you are.
As much as you want us to tell you that it is going to be okay, and no matter if you "were just standing there", you got the charge and now you have to deal with it. The best way to deal with it, is to get a lawyer as soon as the police got you to the station or you received the citation.
