Proposed VA Nursing Rule Riles Anesthesiologists

Our board has failed to clearly define what basic standards of care are in this profession. A nurse taking care of an ASA 4 patient independently is below the standard of care. Studies show there will be poor outcomes. And veterans are the ones receiving poorer care.

The fact that the VA has gone ahead with this model is a dangerous precedent. Any other hospital system could easily follow citing the VA. why not let PAs do hernias next? because lawyers understand that PAs should not practice independently. that's keeps the VA from doing this.

At this point there is one thing that will make them realize this mistake.

Lawsuits!!!

Lawyers must be educated as to standards of care in our profession. The basic is the care team model. Patients who receive less than this are receiving inadequate care.

when one of these nurses screws up, not only should they be sued, more importantly the VA should be sued as well. the VA would get it very quickly.

You guys need more anesthesiologists to become lawyers instead of doing an MBA
 
Physicians are screwed on every level. Most of this is because nurses have stronger lobbies. Let people get what they voted for.

Hypothetically speaking if one of these independent practicing nurses is doing a case and a patient codes, physicians go in to help right?

So who is running the code the nurse or the M.D.?

does the MD then get named in the ensuing lawsuit?
 
Lawsuits Brought by Military Veterans

The Feres Doctrine does not bar inactive military personnel from bringing a medical malpractice lawsuit. This is often the case for medical malpractice lawsuits occurring in many military hospitals.

Non-active military personnel are often treated at military hospitals for the rest of their lives, and as such, are at risk of military medical negligence. Victims of medical negligence in a military hospital may file a suit under the Federal Tort Claims Act for medical malpractice.

Medical Malpractice Suits by Retired Military

Retired military personnel are not covered under the Feres Doctrine, so they are protected by the FTCA, and can bring a lawsuit against the government.

Additionally, a wrongful death of a retired military member may be brought on his or her behalf by their family members.

Medical Injuries Occurring to Military Dependents

If the dependent of a military member, active or non-active, is treated by a military doctor or hospital and negligence occurs, a malpractice lawsuit may be filed.

Either the patient, or the military member may file the lawsuit and will not have any issues relating to the Feres Doctrine.

The issue of military medical malpractice is one that can only be dealt with on a case-by-case basis by an experienced medical malpractice lawyer. Any military personnel, or military dependents injured by medical malpractice are highly encouraged to talk to a medical malpractice lawyer to get answers regarding their legal rights.
 
VA patients routinely get suboptimal care on many levels. I dont think any hospital would cite it as a model if it was hoping that would impress potential patients...
