The best people to ask are the people that will make a difference- the adcoms at the schools to which you are applying. Simply call them and ask their advice. They will gladly tell you. They want people to apply to their schools and be successful. It's business for them. Therefore, a win-win if you call.

I would definetly wait until it it cleared from your record. I have a friend who graduated with a 3.6 from UCLA and had a 29 on his MCAT, but he got a DUI his sophmore year of undergrad and could not get in anywhere! He ended up going to a Caribean school. EVERY application asks you if you've been convicted of anything other then a traffic violation. I would wait, no question.
