ERAS photo - okay to show shoulders?

For the photo, it says you are supposed to have a light background. But I have this professional photo I want to use with a grey background. Will it get disqualified if I send it in, or will they use it anyway? I don't care if it shows up a little dark, I'm too lazy to get another picture.
 
You can bend the rules a little. Check out my picture. I included a bit of the chest as well. They can send me a thank-you-card later.

I was looking through the "MyERAS User Guide" (32-page pdf file I downloaded from somewhere or another on the ERAS site) and happened across this section on photos so I thought I'd share the info:

Photograph
You can assign a photograph to the programs to which you apply. The photograph is attached and transmitted by your designated dean’s office. Programs use the photograph to identify you when you come to interview, and as a memory aid when creating a rank list.
The photograph must:
�� Be in color
�� Show a full front view of your head and shoulders (showing full face centered in the middle of the photograph)
�� Have a plain white or light colored background (dark colored backgrounds do not display very well in the program’s software)
�� Measure approximately 2.5 x 3.5 inches and not more than 3 x 4 inches
Note: All of the above requirements apply to digital photographs, as well. In addition, ensure that all digital photographs are saved in JPEG format. Do not merely remove the file and add the jpg extension.
 
If you go to a main post office branch in your town, you can often get a passport photo to use for this cheaper than at a camera store.
