I don't think RxPrep will report you to the BOP. They said in their email that if the incident repeats or if they find a second violation they will report it. However, this was a one time thing. I think you're good.

or you can try and abide by the terms of service which you had agreed to, and not try to resell the remaining subscription??
I understand it is expensive and you want to get the most out of it, but come on you gonna be a pharmacist (assuming you passed) and you got what you needed out of the service you purchased .......

Initiate a charge back and they pretty much have no proof of anything. Gimme a break.

Or can you register under a false name and use a VPN to access it? I do that all the time to various websites.

Don’t be too sure. The board has a morality clause. This fool got his license taken away:

Even if they do report me, does the board really come down to me for stupid shot like this? I think rxprep is somehow being delusional there and thinking they own the state governments.

No - the people at Rx prep are aware that pharmacists are mostly sissies and they are just trying to make you pee your pants - and it worked.

The BoP has no bearing over your dealings with rxprep. Come on man....

I would email them back to go to hell!!!!! What an over the top response!!!!!!!!!!!!!!!!!!!

LoL tell them to pound sand.

Of course they can cancel your subscription for breaking the terms of the contract

Email them back saying you'll hear from my lawyer and you'll be prosecuting them.

Lolll. so what exactly are you more concerned about, deactivation of your account or reporting to the board?
Why are you so worried about any of this? If they deactivate your account, you already passed your boards so who cares... if they report you to the board, chances are nothing will happen.

I’m more concerned with my legal rights as a consumer. To be honest, I’m not particularly worried about the reporting BS but if they terminate the contract earlier than what we had agreed on, then I should be able to get my money back for the rest of the months. right?
You, who broke the contract, want to stake your claim on them breaking the contract they didn’t break?

They have the right to terminate the contract earlier because you violated the agreement.. what part do you not understand?

They don’t even have to report you. They can just post your email and name on their Facebook page. Imagine how that would affect your career?

I remember that, but manufacturing counterfeit goods is a federal offense (18 USC sec 2320).

Violation of a private contract (T&C’s) is a civil matter, and to my knowledge a BOP won’t take your license away because you had a spat with some online site.

**also noted that the respondent pled no contest to a misdemeanor offense for a state statute on counterfeit items

All you judgy people need to read better. OP didn't actually sell the materials. They posted an ad that went nowhere. As long as they didn't actually break the terms of use, it's 100% legally fine. And even then, it would be a civil matter, not a criminal one. You might get sued, but that's it. In fact, they owe you your access back or your money back, prorated.

And threatening your livelihood like that would make my blood boil. Imagine if this piece of **** actually got someone's license taken away for this trifling nonsense.

If this were me and they actually got my license taken away, I'd spend the next few months of my life finding where the person running this thing lives and making their life pure hell. I'd be behind 3 VPNs paid for with bitcoin, bought with cash at a BTC ATM 500 miles away. Using wifi at a Starbucks somewhere 300 miles from my house. Wearing a wig and sunglasses the whole time. I would cause chaos. I'd make something good and life destroying happen like sending escorts to their house when their wife was home. I wouldn't go as far as risking their life. Swatting someone, for instance, is probably over the line. But their business, finances, family life, and general happiness would be fair game to me. And I would destroy them 40 fold what they did to me.

But, alas, they didn't do this to me. Lucky them.

If that’s the case they should definitely expect a defamation lawsuit

For what? For posting what you had sent them? Those are your words.

All of this work and risk for what? So you can make $100?

Yes, the chargeback code is 30/13.1 (Visa) for merchandise not received. You have 120 days from when you last expected to receive the service or the date of their email.

You might need proof that you attempted to resolve before chargeback, so carefully threatening rxprep for false accusations and that you will initiate a chargeback might be effective/prudent.

And he has the right to chargeback the amount from rxprep for failure to deliver services as described, regardless if he’s guilty of violating T&C or not.

That’s the merchant agreement rxprep signed with their processor.

Hell, I could report you to the board for this thread if I wanted to. What happens after is up to them.

Why are you making this such a big deal? You tried to sell when you weren't suppose to and got caught. How much money are you expecting to make from this? From what I remember, they provide you with up to 6-month access... Why do you need to re-access the study prep when you already passed the exam? Why go through all this trouble. let it go and stop being petty.

Again this is not about the $$$$$ or my license anymore. This is about my legal right as a consumer. I am willing to fight this battle against them for me, for you, and for everybody in the universe.

YEAH FIGHT THAT BATTLE FOR EVERYBODY IN THIS UNIVERSE. the rest of us don't have time for that.

Well, also since I just got out of school and can’t afford to have an actual lawyer yet, You guys are my best sources of opinions, can I sue them for that email, I feel like I was somehow blackmailed and threatened.

If you sue them, your email would be included in the lawsuit. So when someone google your name, this would come up. Do you want to be forever associated with this crap?

This guy is just butthurt. Welcome to the real world, buddy. No one here really care about your feelings.

Do some pushups and watch a funny movie, you need to move on

Actually I kinda want him to push this. Start a media campaign on this injustice! It would be interesting.

I am not sure I follow your logic. RxPrep absolutely did deliver services as described. They described deactivating the account for violating the TOS (presumably). On what grounds could OP argue he is owed a charge back?

I imagine attempts to sell are against their TOS, so I suspect you are in error about that point. OP likely did break their terms of use.

Otherwise I mostly agree with your post. Threatening to go after someone for something so trivial and widespread is ridiculous. It would be like the TV movie or music industry going after people for pirating. That ship has sailed people, get over it.

Either initiate a chargeback for not receiving the full access to a product you paid for or move on. You passed the exam right?

OP take this as a lesson learned, don't be stingy next time. You're making a big deal out of nothing, you could be chilling at the beach right now. Most classmates would just let each other borrow their logins and not charge them anything like with Netflix accounts.

we will report the unethical behavior to the state board in which you are licensed, to your employer (if known) and will initiate criminal charges.

Sound like every single threat that I hear from patients who do not get their way (albeit more coherent). Rxprep must really want to prep its users for their future career.

Technically rxprep did not fulfill complete delivery (like they provided 10 out of 12 months or something), which is what I presume the OP was trying to sell on SDN.

Given the flat cost handed to rxprep for any chargeback, if the OP wants to be vindictive, they should just do it.
