Currently a pre clinical medical student. On new years eve, I was issued a public urination ticket in NYC, (I was not handcuffed, booked or fingerprinted - just issued a ticket by a officer). According to the ticket, what I was issued was administrative code violation and not a misdemeanor or a felony. After some research and consultation with a lawyer, I found out that these violations do not produce a criminal record and are not seen as crimes in new york. The lawyer said that since this is not a crime, this violation will not come up in criminal background checks. However, there will be a public record of this violation at the courthouse if I plead guilty - (if I pay the 50 dollar fine) - which I have not done yet.

I know I am going to have to rotate at the VA which runs federal background checks (FBI like checks). From what I have heard, I know these background checks are more exhaustive, so I am not sure if this violation will still come up in their check even though it is not a misdemeanor or felony and does not produce a criminal record. Thus, I was wondering if anyone who has gone through a similar situation has any advice? I would also appreciate any advice from others who may have knowledge of the VA or knowledge of people who received violations like this medical school. How will this affect my future.

I know this was a very stupid act and I am currently freaking out about it, so I greatly appreciate y'all's advice in advance.
 
Public urination is a misdemeanor in NY. 99% of the time they will reduce the charge but have a lawyer there.
 
From what I understand, a ticket for urination would be just a municipal violation (speeding tickets, jaywalking, etc) which wouldn't show up on the background checks that the medical schools run. I think the school is usually looking for misdemeanors and felonies. However, some MD and DO schools (I don't remember which ones) would ask about municipal violations and you would have to disclose it (on a side note if you interview for those schools I got a feeling it would be an interesting conversation). When you apply you should double check with the school but a ticket looks pretty minor and wouldn't have to be disclosed if it isn't a misdemeanor or felony (from what you wrote).

Mine was not a misdemeanor. It was written as a administrative code violation which is not a misdemeanor or a felony - i think its akin to a ordinance violation.

@NY2015, I am already in medical school. I just don't know how much of a problem this will be when rotating at hospitals like the VA which run in depth background checks. It's not written as a crime (not a misdemeanor or felony) so I am confused as to whether this will present a problem or if its just a fine and my life moves on - kinda like a traffic ticket.
 
ooo in that case you should then check with your school's rotation coordinator about that.

Possibly, I do not know how strict they are with medical students who rotate there

Can you order your own background check and see how it shows up?

Chances are that even if it shows up, it's fine.
