So... if you sign on with a major CMG that includes a bonus that is paid up front and then they end up losing the contract...

What happens to the sign on bonus that included a term commitment? Null and void? Survives and is a new obligation to the hospital?

Yes, I know a corporate attorney is the best source of advice along with the specific language, but I was just curious as to whether anyone had ever been in a similar situation or knew someone?
 
If you got the bonus, you either have to work for the company, or pay it back.
If you didn't get it, then I wouldn't expect it from the next group necessarily.

A friend of mine signed a contract to work at a specific hospital with a large staffing company. He received his bonus upon signing. A year later, they lost the contract for that hospital. He stayed on as a hospital employee. The company asked for the bonus back as he had not completed the required 2 years. He told them he wasn't paying it back and had a lawyer explain that the company lost the contract and he had acted in good faith by signing to work at that hospital for that company. They backed off, but probably because it would have cost more than it was worth to get the pro-rated amount of the bonus back.
 
Yea, I have a feeling I'll need to get a corporate attorney for interpretation. I got the money up front and now the company lost the contract and I'm stuck in limbo. They haven't asked for it back yet but I'm not the type to just sit with my fingers crossed and hope that my last paycheck doesn't get deposited, etc.. I plan to either continue working at the hospital or look elsewhere depending on how everything pans out but I don't really think I would consider working for them at another location. I'll have to think about it... The ED director seemed to insinuate that it wouldn't be an issue and that the money actually came from the hospital but the addendum in my contract as I read it is pretty specific and seems to strongly state that this is a contractual obligation with the CMG company itself and has nothing to do with the hospital. What a drag... Everything was going great and then this happens. I can remember thinking how safe the sign on would be considering the CMG had carried the contract for several years without losing it... and now...they lose it. Good grief.
