how do you apply to these programs if theyre not participating in SOAP?
will they fill their positions after soap or will they fill their positions through candidates contacting them without ERAS?

I think those programs will simply leave those positions unfilled.

Someone can confirm/refute this though, since I'm not 100% sure.

If a program isn't participating in SOAP, it can:

1. Interview and fill with applicants not participating in SOAP at any time.

2. Interview and fill with applicants participating in SOAP after Friday.

3. Not fill those positions.

So can we contact such programs at anytime (without it being a violation)?

like to know this as well and how do someone find out about these programs if they have no access to SOAP data

Only if you did not participate in the match. If you registered with the NRMP and didn't match today, you are by definition participating in SOAP and can't contact them until after the Friday deadline. A bunch of DO's got into trouble for this last year -- didn't match, then "scrambled" into a DO spot. Can't do that until friday.

what are the ramifications for a DO scrambling into an AOA during SOAP?

The first statement, I believe, is incorrect. If a program is participating in the Match which I would presume is the case if they are included in the list of unfilled programs, they are prohibited from filling those positions during Match week outside of SOAP.

From the "Institutional Officials and Program Directors" FAQs on NRMP's website:

Am I am eligible to participate in SOAP? What if I don't want to participate?

All Match-participating programs with unfilled positions are eligible to participate in SOAP. Through the R3 system, program directors must notify the NRMP prior to Match Week whether they wish to participate in SOAP should their programs go unfilled. If you elect to participate in SOAP and you have unfilled positions, you may accept applications from eligible unmatched applicants only through ERAS®, and you must submit preference lists and extend offers only through the R3 system. You may elect not to participate in SOAP, but if you do so you are prohibited from extending offers to any applicants, regardless of the applicant's SOAP-eligibility or Match participation status, until SOAP concludes at 5:00 p.m. eastern time on Friday of Match Week

You cannot do it. The NRMP SOAP match legally binds you to their process.

If you try and do it anyway I'm pretty sure you'll be screwing your chances for the SOAP and perhaps matching in general.

My apologies, I misunderstood the question.

If a program was NEVER in the NRMP at all (i.e. they were "all out"), then you can apply to them anytime. That's what I thought the OP was referencing when they described "positions not in SOAP"

If a program was in NRMP, has unfilled slots that are labelled as "not participating in SOAP", then you cannot contact them until after Friday (as above). However, you should also be aware that those programs are unlikely to fill those slots. They are often research spots or other special tracks, and if they don't fill they are left empty.

how does one even find out about programs that were never in the NRMP?

I would like to know about this as well. I have a very close friend who did not match and is trying the SOAP but according to him there are very few spots for anything other than prelim surgery. I know a guy from last year's class who found a prelim spot after the SOAP was over but not sure how he found that.

they got in trouble and did not match BECAUSE of contacting programs?
