I believe that Certificate of Need laws are more harmful then good.
I am of the opinion that states that have these essentially gifted more power to health systems and hospitals by limiting competition and even customization of units. For instance I have seen in other countries an environment where physicians will open their own miniature hospital or even a unit. I believe ending CON laws could be a positive influence in healthcare, especially for Psychiatry. Envision a C&A doc duo who open an 8 bed unit and only admit say, 6-10yo? Or conversely a Psychiatrist who specializes in severe OCD, has a 6 bed unit, and with the evaluations and treatments done with thorough history taking could even be the ideal person to make referrals to DBS centers. Or even a 6 bed postpartum unit.
Smaller hospitals that have a general 15-40 bed unit are a one size fits all, and contributes to some patients reflecting on the experience there, at time due to other patients on unit, "I will never go back to another hospital again!" To some degree Community Mental Organizations are already doing this with their crisis stabilization units.
In summary I believe more good than bad could be produced with an end CON laws. I would love to hear from those who live in states that don't have them, what they've seen?
