Criteria for taking DAT more than 3 times

If I want to take the DAT the 4th time or say the 5th time hypothetically speaking, I know you have to ask for a special request to do so. I took the DAT once around 2003 but never had the chance to apply due to personal circumstances. I am planning to take my 2nd DAT exam during next month but planning ahead and for the worst. Anyways, my question is....

1. Can I retake the DAT as long as I have a rejection letter after the 3rd time?

2. Does anyone know why they changed the rules to only allowing you to take no more than 3 times without a special permission?
