Delayed start due to visa processing issues?

I am opting for H1B and it seems that there will be a possible delay of my visa processig.
It turns out that the medical board did not receive all the documenta from my program. They notified the program 2 weeks ago but no one at the hospital received the notice. I found out today because I contacted the board myself.

Is it ground for dismissal because I wont be able to start until 1 week into my residency?
I already paid the lawyer for premium processing.
 
Theoretically, yes. Realistically, no.

Technically, if you can't start by July 1st, your program can apply for a match waiver. But, in the case you describe, it sounds like the reason that you can't start is because your program screwed things up. In that case I expect the NRMP would not grant a waiver. If your program does apply for a waiver, then the NRMP will contact you to hear your side of the story (so you don't have to worry that they are going to do this behind your back).

More importantly, it's much easier to wait for you to start a week later than to find someone new to replace you. So even if this was your fault (which it sounds like it isn't), they would probably wait for you to start.
