I finished an internship last year with no problems, and matched into a competitive specialty to start July 1 on opposite ends of the country. The licensing board waited until early July to inform me that I needed to meeet with them but not until this last week (9 weeks) into the PGY2 before issuing a license. The issue was 2 misdemeanors both nearly 3 years ago🙁one for verbal assault of a cab driver)- law has since been thrown out as was defined as "causing apprehension" is grounds for assaut, was found as unconstitutional. My conviction still stands. The other was a domestic violence issue witha girlfriend that I had broken up with. They insisted on seeing the police reports which looked bad, but no evidence of physical assault in either case. Anyway- the board informs my attorney that they are worried about my morale. So, no license. I have the option of appealing-but will then be blacklisted as denied licensure, or I can withdrawal. Just moved coast to coast with fiance- and now unemployed. Program totally supportive, and the board basically denied me. At the board meeting, I took the advice of my attorney and just stated that I was ashamed and remorseful, and didnt really verbally defend my innocence. What to do? The field I am in/or was in very competitive! ?? Appeal? Take a year off? Same issues with licensing in other states? Try and match again? Any advice appreciated

A new lawyer.

That sucks. Which state denied you? Some are worse than others...

At the board meeting, I took the advice of my attorney and just stated that I was ashamed and remorseful, and didnt really verbally defend my innocence.

Good advice from your attorney. You are not innocent (you either got convicted or you plead guilty), proclaiming you innocence in the medical board interview would have been a mistake. It is like the parole hearings, unless you fess up to the crimes (whether you committed them or not), they never let you out.

What to do? The field I am in/or was in very competitive! ?? Appeal? Take a year off?

Go back and have a good criminal defense attorney work on getting the cabdriver conviction thrown out. If the law has indeed been found unconstitutional, you should be able to get it overturned.
As for your domestic violence issues, I don't see how you will be able to get that cleaned up.

If you just appeal the medboards decision, it is pretty likely that they will turn you down again. You'll have to clean up your record first.

Same issues with licensing in other states?

Different state, different rules. Some states only care about either drug related convictions or felonies. Indiana recently licensed a guy who had spent 20years in the Pen for kidnapping and attempted murder, so going somewhere else might work.

Is there anyway you could apply for a temporary license and then maybe some sort of a probationary period. Sometimes for educational/residency training they may grant you a license for just the training.
