Hey everyone,
I have an scenario I'd like feedback on. If a minor is diagnosed with a pregnancy or STD, I know that patient confidentiality trumps parent's rights of legal guardian. Everything I've read, at least for my state, says "parents are not to be notified, etc." Most scenarios like this that i've encountered have a young women coming with a friend/boyfriend/sibling to a clinic visit.
What is the obligation, legally speaking, for a physician when a patient is brought to the appointment by a parent? and what is the obligation if the minor is open during the H&P about sexual activity and does not ask that parent to leave? Would this still be a legal breach of privacy to then inform the patient while the parent is in the room of a diagnosis related to the admitted sexual activity?
Any help would be greatly appreciated, especially if you know a reference to a legal source. Thanks!
