Hello everyone,
You might remember my post from a couple of months ago..I got this speeding ticket, I was going at 94 mph on a 70 mph zone. I live in Florida.
The ticket said I didn't have to go to court. So I hired one of those law firms that work to get rid of your ticket so you don't have to pay the ticket, nor it would be on my record. The court date is on January the 4th..I don't have to go and everything should be forgotten in a couple of months..It shouldn't even be on my record.
Now..I will be applying next application cycle so I was taking a look at the 2010 application. For the part of felony conviction and misdemeanor what would you answer? Yes or No?

Will it be a misdemeanor? If you haven't been convicted, you don't need to put anything yet. OTOH, if you are convicted and its a misdemeanor or felony, it's going to come up when they do the background check. You should probably consult a lawyer on this, not SDN!

What makes you think it's a misdemeanor/felony? You should be able to find this info with Google. If you can't then check with the lawyer you're working with now.
 
Unless your ticket is for reckless driving (24 miles over the speed limit may be considered reckless), then it's not a misdemeanor and certainly not a felony.

A civil infraction, which is most likely what your ticket is, will not show up on a criminal background check, because a civil infraction is legally not considered a criminal offense. In other words, don't sweat it.

I'm going to ask my lawyer later on today just in case...but i'm also pretty sure that's the case...Thanks!!
 
Getting a speeding ticket isn't a misdemeanor or felony.
 
I've never heard of a felony speeding ticket.

However, depending on where your excessive speeding was (i.e. residential, schools, etc.), I think I've heard of it acting as a 3rd degree misdemeanor or something. Since you said it was 94 in a 75, I think it's safe to eliminate both. Like everyone else said, consult your lawyer. Btw, there is no good reason to be going so fast unless it's an emergency. Just follow the flow of traffic. 😉

Not necessarily true. It depends on the state. In my state, Ohio, a speeding ticket is a minor misdemeanor.
 
In most states, you don't have to report minor traffic violations when asked about criminal history. It seems from the poster above me that there are some exceptions? I guess find out for sure then. If you don't find out from your lawyer, put down the title of your ticket on the misdemeanor section just to be safe. The adcoms will probably have a good laugh. I myself am having a laugh (in a very kind and good-natured way) that you PAID A LAWYER to get out of a speeding ticket. :laugh: :laugh: :laugh:

Lawyer here. Yes, you need to talk about this with your lawyer. With all due respect to the posters on this thread, this is not the place to get accurate legal advice.

Yes, most questions about criminal history exclude minor traffic offenses, no matter how they are classified ("Except for minor traffic offenses, please state whether you have been convicted of or charged with a felony or misdemeanor criminal offense..."). It's all about reading the questions carefully and answering truthfully, erring on the side of disclosure.

Haha actually it was the best option. Hiring the lawyer was just 70 bucks. The ticket was for 280. I might have to pay court fees but they are ussually less than 280 bucks lol. Also, I don't have to worry about the ticket, no school no nothing..it won't be on my record aaaand my insurance rate won't go up... so it was the best option.

I didn't post this threat to make a decision with the advices that you guys gave me... I posted it to see what you thought..I was still going to call my lawyer regardless of what you guys said. Thanks for your opinions/advices.
 
I was going 62 on a 30 last year. Got my licence taken away for 20 days.
Not a misdemeanor nothing. Yeah it shows up on file but for police only.
Med Schools won't know a thing! And if they someone find out using the FBI.
Then just be like I HAD TO GO SAVE PEOPLE FROM DYING.

Hahahahahahahah Doctor Speed haha I like that...Yeah well...I just moved here about 2 years ago..and where I used to live..nobody paid attention to the speed limit..so it's been kind of hard for me to get used to it..haha
