Dear Prospective Residents of any Residency Program affiliated with FIU Health Graduate Medical Education,

Based on personal experience and corroborated by a number of other residents, I am writing to warn you of training in a residency program under the supervision of **REDACTED BY MODS** who serves as Associate Dean for Graduate Medical Education. Despite having 3 years to fulfill his obligations as Program Director in his most recent position, he deliberately failed to meet ACGME Common Program Requirements jeopardizing the program's accreditation status and the careers of many residents. He does not value graduate medical education. He was rarely present in his role as PD. This individual's capacity to serve in GME needs to be further assessed by ACGME.

So you got in a spat with your program at FIU - a small program where problem residents probably aren’t too common - and are now going public on an anonymous forum in an attempt to shame them. I am sure this will work out great!
 
Libel/slander only works if the plaintiff can prove by preponderance of the evidence 2 things: that what is being said is *untrue*, AND that it has caused harm, and IIRC to prove harm is somewhat nebulous, I think if you can reasonably show monetary damage that is easier than other types of "harm."

It also depends on what is being asserted. It's fine to have opinions about people. You get into more trouble if you ascribe words and actions to people, rather than your opinions on their motives.

There are a few things in this statement that could be on the verge of that, but again, it would be on the program to show it wasn't true AND that what this person has said has caused undue harm as a result.

People wrongly think you can't go around saying bad things about an employer. You absolutely can.

I looked into this pretty heavily when I caught my ex cheating and put up fliers around town about it. ETA: No I did not actually do this, but I did look into it. Everyone's entitled to unlived revenge fantasies.

what exactly was the issue with that guy? He was the guy who had a picture with him kneeling and would knock on your door or something who got fired out of some surgical program? where did he end up?

Ugh I'm in sort of a good mood and don't feel like rehashing this story.

To my knowledge he hasn't gotten another training position... there's no one on the planet that would be willing to take the chance.

This I agree with wholeheartedly. I get annoyed when people exclaim "you can't do that you'll get in trouble with the law!!"

It's like, no, you can, but that doesn't make it a good idea regardless.

Him getting fired had nothing to do with him kneeling.
Libel only applies to a person, you can say what you want about a company but risk slander or defamation charges (again, with proof of damages).

I would argue that it’s easier to get into trouble and become a problem resident at a small program. You don’t get the opportunity to blend in and mesh in and hide out in a sea of people. Mistakes are easily noted and personalities easily stick out.
After my experience I advise against small programs especially as a minority. With the exception being if your training program is full of minorities.
