Match violation?

I unfortunately had to Soap this cycle and got a surgery prelim. I've been reading how difficult it would be to continue in surgery as a prelim and I was wondering, if I find an open spot in another categorical program due to people dropping out or whatnot, would it be considered a match violation if I tried to transfer out of my prelim?

Yes. Per NRMP rules, you must show up and be there at least 45 days.
 
To clarify, after 45 days it's fine. So if someone drops out now, you can't try to get the spot. But if they drop out after 45 days, you can. Hopefully your prelim PD will help you secure something for your next year. Reapplying for GS as a PGY-1 in the match is not unheard of.
 
Thank you very much for responding. I just read about a new residency opening up, would it be considered a match violation if I emailed the program director and inquired about their positions?
 
I don't think it will be if you just inquire about their program. It's not like you are getting an offer or accepting one. And match/soap is over. So, as long as you don't transfer to another program before mid August, I think you should be fine.
 
This is a grey zone. If you contact them and ask about possible PGY-1 spots for this year, then yes it is technically a match violation as you are already committed. If you contact them and say you've matched to a prelim but may be interested in a PGY-2 for next year, that's totally fine. And, if they contact you in 3-6 months and want to you to transfer as a PGY-1, that's also totally fine.
