Man says prescription drug caused compulsive gambling

A former Wall Street banker who said he lost $3 million from compulsive gambling caused by a popular drug used to treat Parkinson's disease is suing companies involved with the drug for his losses.

The lawsuit, filed in New York State Court on Tuesday, accuses the privately held German drugmaker Boehringer Ingelheim, Pfizer and Pharmacia & Upjohn of breach of warranty, negligence and negligent misrepresentation.

Randolph Simens, 55, said that he took the drug, Mirapex, from 2002 to 2007 after being diagnosed with Parkinson's disease and suffering hand tremors.

"It put a little tickle in me and then snowballed within a month," said Simens, who filed the lawsuit in New York State Court on his own because he said he cannot afford a lawyer.

A spokesperson for Pfizer said the company had not marketed Mirapex since 2005, when medical studies first linked the drug to compulsive behaviors, including gambling.

Pfizer said that it had "acted reasonably and appropriately during the entire time period it was involved with Mirapex."

Mirapex is still sold in the U.S. market and is also prescribed for restless leg syndrome.

The defendants "had a duty to provide adequate warnings and instruction for Mirapex, to use reasonable care to design a product that is not reasonably dangerous to users, and to adequately test their product," the lawsuit said.

A successful banker, Simens said that he had been a recreational gambler before being prescribed the drug. But he said he quickly became reckless, spending entire nights gambling over the Internet and traveling to casinos.

"It's stupidity. I just couldn't stop," he said.

After reading an article that suggested a link between Mirapex and compulsive behaviors, including gambling, Simens said he felt a wave of relief.

Simens, a father of two, joined a gambler's support group and, within five weeks of getting off Mirapex, he had stopped gambling, he said.
 
So typical of our society....Nothing is my responsibility....Its everyone elses fault.

Remindes me of a story I read back in Kansas. A guy sued the casino because they should have recognized he was a compulsive gambler and stoped him. He must not have been on prescription drugs and had to come up with something else......
 
Its crazy how people will file lawsuits about anything nowadays. Maybe I should have been a lawyer instead 😀

I was thinking the same thing. Whats sad is if this guy wins some sort of settlement there are going to be a crap ton of people filing the same type of suit that were on that med.
 
It is listed as a side effect though, our neurologist told us about it.... excessive gambling, hypersexuality, etc. really interesting stuff.

It's called the dopamine dysregulation syndrome.

This side effect has been know for several years and there already has been a class action lawsuit a long time ago I remember seeing tv ads for it. Not sure if its settled or still on going.

I bet this guy had a gambling problem to begin with, i guess it possible that this med could increase the urges but still not to the point it got too... Every gambling addict starts off recreationally at first... he probably would be in same boat without ever taking med.

In fact I did a rotation at a psych hospital and their was a NURSE that was a patient who lost all her money at the casino and would talk about being on this med and it caused her to lose all her money. When asked about her dose it was some really small dose at bedtime for RLS. I am almost certain she knew about side effect and got on the med so that she could use it as an excuse to feed the addiction she had before the med was started.

I am still waiting for the lawsuit that this med gave someone HIV because they needed to have tons of sex with random people.
