NOVA is asking about expunged records and even wants Juvenile records...I have three arrests as a minor....underage drinking and two pot related incidents. It's making me wonder if I should even apply, I don't feel like writing a lengthy explanation would make a difference if they see three arrests, even though I haven't smoked pot in 7 years and barely drink and exercise like a beast now. Any advice?

If its expunged they can't see it right? That's what I thought expunged records mean. If so I wouldn't worry about it.

Thats true, but they ask to list even the expunged incidents. I mean WTF is the point of getting it expunged if you have to convey that you were arrested?

Haha that's what I'm saying. I wouldn't divulge anything that was permanently removed and no trace of the incidents could be found. I know that sounds incredibly unethical but you seem to have grown from the experiences and moved on. No need in rehashing the past that could potentially hurt you. Just my opinion though. You gotta do what you feel is right.

I feel you, I don't think it's any of their business. After all, so what if you dabbled on the wild side a bit when you were young and then stopped partying. I would rather be that guy then the dude who has never had a drink in his life and becomes an alcoholic at age 40 when he's a reputable doctor

Check your state law.

Some states have laws that explicitly state that once something on an arrest and/or criminal record has been expunged you can legally testify in court that you have never been arrested and/or convicted. Which means on any legal document you can check the "no I have never been arrested, charged, or convicted" box

It sounds like this may be the case. Do some digging before you give up, depending on how badly you want it. A family member or friend who is also a lawyer will be helpful for free advice, if not if you already have a lawyer you've used in the past might give you some free advice, if not gather up some dollars get on the phone and consult a lawyer if you can't find the answers to this dilemma yourself.

That seems to me to be more unethical of them to ask something like that than for you to not list an expunged incident. As you said, what would be the purpose of going through the hassle and cost of getting something expunged if they can still ask about it?
