so…Doctor Gas gets sued. Plaintiff then drops Dr Gas from the suit but names his anesthesia group, who settles for $100k.

Does Dr Gas have to report to the National Data bank?

No. But when you reapply for staff privileges anywhere or for insurance with another carrier, you will be asked if you have ever been involved in a malpractice action and you should answer truthfully.

Are u sure? Like if u work for company A. (Federal govt, or state govt that has sovereign immunity) you will get dropped from lawsuit most of the time.

It’s a grey area. About being “sued”.

Now even if the feds or state settle the lawsuit and take the hit. You can still get hit with a national provider dababase settlement claim

Pretty sure that nobody has a duty to self report to NPDB. Your Med Staff office, employer or insurance company is supposed to take care of that😱 . Just one more reason that one should answer the question "if you have ever been involved in a malpractice action?" truthfully. You are supposed to be notified if there is an NPDB entry from anyone. One can always do a self query to see if there was an entry from a closed case.

FYI, 20+ years ago when we were a private group we wanted to deal with some Dental injuries ourselves...bad technique from a CRNA, student or doc. We were advised that if the group wrote a corporate check to the patient we had a duty to report. Same if our insurance carrier wrote the check, they had a duty to report. If the doc wrote a personal check...No duty to self report. That was the advice of our lawyer at the time. Not sure if accurate now or then, but that is what they told us.

I was confusing self reporting to state medical board with NPDB. So would they have to report to state? Probably depends on the state?

I am not being sued but our group was named in a case where the individual was dropped, so it’s been a topic of conversation.

Are we supposed to self report?? Because why??? Why would I do all that?? What kinds of things are reported to the NPDB anyway and why is it on us to do the reporting??
Sometimes I feel like we docs are a bunch of scared kids. Because sometimes bad **** happens in this job. I will let someone else try to piss on me Thank you. I won’t do the pissing willingly.

I suspect that the entity that wrote the check (unless it was an individual with a personal check) has the duty. Not sure if they have to disclose the indvidual doc who was dropped.
 
I was named in a malpractice lawsuit once along with about 6 other docs. Basically an upset patient that sued everyone involved in their care no matter how small the role. I was dismissed from the lawsuit early on. There was no report to the NPDB for me. When I re-applied for my state license I did self-report I was named in a suit, they wanted a brief summary of what was happening, and to update them as things progressed. It was fine, never had any issues keeping my license and once I was dismissed they no longer needed anything. When I took a new job I also let them know and they couldn’t have cared less.
 
I’ve known docs with sentinel events (like MD only outpatient Gi death). Crap happens we all know. But they immediately signed w2 contract and stoped doing locums. So on their applications have you ever been sued? They can truthfully check no.

Because I’m sure a lawsuit is coming. It may be months or the lawsuit may not even come. Who knows. But they immediately signed a w2 contract to hide out for a while. To avoid such disclosures.
