Hi guys,

I started interning at an outpatient site in NY and i'm really confused with the law. I was hoping some one can help me out..

CII; 30 day supply with no refills. W/code, can have more than 30 days but still no refills
-can have 5 day emergency supply w/ no refill-> requires hardcopy within 72hrs otherwise BNE
-gonodotropin:can have 3 months supply with one refill
-anabolic steriod:can have 6 mo supply

CIII, IV and V: can have 30 day supply with 5 refills
CIII and V: emergency: can only call in 5 day supply with no refill (?)😕
CIV: can call in 30 day supply or 100 units, which ever is less with no refills (?)😕
-just document if no hardcover

-all controls exp in 6 months.
I thought i saw a pharmacist took a verbal script for SOMA (fed CIV but not cs in ny) with refills in it. I thought she said that you can get refills on oral for Civ? Please let me know if i got this right and if someone could clarify this paragraph down here..much thanks!!:scared:

Soma is a control in NY now...I think they can call in upto a 30 days supply...but they should send a cover script, for that 1 and another script with refills...im not sure

Wait can someone clarify this for me..

In NY, if an office CALLS in a C-III or C-IV it can only be emergency 5 days, and they have to send you an Rx hardcopy. They can't call in more than 5 days..

But, C-IV can be CALLED in as full 30 days supply or 100 units (whichever is less)?

..So the C-V which is less abusable than C-IV cannot be called in more than 5 days, but C-IV which is more abusable can be called in for more than 5 days?

Here is a quick summary of calling in controls in NYS:

CII, III, V, and benzodiazepines: 5-day emergency supply only.
Non-benzo CIV: 30 day supply or 100 units, whichever is less

Cover prescription must be delivered within 72 hours. For CIIs and benzos, if the cover is not received in 7 days the pharmacy must contact the Bureau of Narcotic Enforcement stating that it was not received. For the others you need to write "cover not received" on the hard copy.

Controls cannot be faxed; the exceptions are if the patient is in hospice or a residential healthcare facility. In those cases a control can be faxed (the script needs to state that). Any other control faxes received need to be treated as an emergency supply (5 days, cover, etc.).

Controls cannot be e-scribed in NYS
