Please help me on misdemeanor status.

I have completed my DUI (misdemeanor C) case and probation completed and case was dismissed by the court 2 years ago.
Since it says on exclusion #3, Do I click no on this question?
Or Do I still click "yes"?

I would like to be honest and make no problems.
The question is pasted below.


"Have you ever been convicted of, or pleaded guilty or no contest to, a Misdemeanor crime, excluding 1) any offense for which you were adjudicated as a juvenile, 2) any convictions which have been expunged or sealed by a court, or 3) any misdemeanor convictions for which any probation has been completed and the case dismissed by the court (in states where applicable)?"

Would anyone please help me on this question..?

Technically it if has been sealed or expunged you still have to report it.

Really? Im not too sure about that. I believe I have heard otherwise on these forums.

I have one thats nearly 10 years old which I was about about to get expunged in the next year or so when it becomes eligible. Attorney seemed to think it would be a non-issue on the app if it were expunged.

I don't think OP has attempted to expunge his record. I think he is asking if he needs to report the DUI if the court dismissed the case.

I totally misread OPs statement as well. @youngmo it says 'excluding' on the question...so according to this particular app you wouldnt have to report.

The prompt doesn't care about expunged or sealed. It has to be reported.

Reading comprehension 101 folks. This one appears to fall pretty clearly under the exclusion rule.

the case is dismissed and completed but not expunged yet. (expunged 2018,april)

You may answer no on the AMCAS primary application if it has been set aside by the court. Some schools ask about charges in the secondary, for which you would still have to answer yes (along with the explanation).
