I was officially dropped in a summary Judgement after 8 years of turmoil (case progressed very slowly)

The plaintiff “expert” witness works 2 miles away from me.
The entire case was garbage and standard of care and EBM was exceeded. It was frivolous, even my attorney felt so.
This “expert” basically lied through his teeth for the money ( he even had a website advertising his expert witness work, and advertises on legal sites)

Anyone ever hear of an expert witness being sued for slander/libel? I’m very much considering it and don’t care about the cost, I’m tired of these people grabbing money and making things up as they go.

At the very least I want to Dox this guy to his job, colleagues, and EMDOCS.

I know, I’m just raging right now ….

I actually agree people who lie as an expert should be accountable to their specialty boards at minimum

Happened to Peter Rosen. If this guy was as blatantly deceitful as NYEMMED makes it sound, reporting him to ABEM is probably a good idea.

Yeah I guess if I was OP I might look up the lawyer that took Peter Rosen to ABEM who was apparently a JD and an EM doc?
 
OP, having been through this, my best advice is to do nothing and try to move on

Reason # 3758 why EM sucks.
Burn it down, no down side. No lawyer will want an expert witness under investigation. Hire expert witness #999 instead. Expert witness will have an established relationship with you too and less attractive to be used against you.
 
My old group had docs that were so bad as expert witnesses leadership had to give a group notice that people that wanted to be an expert witness needed admin approval for the activity

Apparently some were so awful it just reflected on the group as a whole

EW work is one of those things where you think it looks easy until you ruin someone's life

side note: hope this wasn't in the midwest, would hate for this to be further collateral damage from some of our dip**** docs dragging everyone down with them

Second this, as well as reporting to state medical board. Got nothing to lose.
 
Not a lawyer, but I don't think you can sue an expert witness (or any other witness) for slander. After all, they are just expressing their opinions.

I do think they should be held accountable for their opinions. If I was hiring someone I would want to know whether they said something completely insane. I wonder if there is a way to factually share that with their current employer.

Doesn't sound like something that's worth getting into though.
 
If the expert was that egregious your lawyer likely could have filed a Daubert motion to stop their testimony. You can possibly sue too but the bar is ridiculously high and a likely waste of time.

Don’t bother going to a state medical board. It’s the specialty group that you need to contact. If it’s an EM doc then you can go to ACEP.

That said, you are much better off just moving on. Why hold onto all that negative energy when you’ve actually been set free?
 
Sounds like the wise move is going to ABEM. I also see very little downside with going this route.
 
It would be cool if ABEM did something. But I worry they won't and just made an exception for Rosen because he's such a big name.

It would restore some of my faith in them if they took action against random rogue docs but that feels less likely
Yeah sadly I imagine part of the issue is that the people on the boards of ABEM (or ABIM in my case) tends to be academics who side hustle doing witness work themselves so why would they kill the goose.
