I've just finished a book called The Criminalization of Medicine. It details how the government and the legal system of America is able to go in after physicians and dentists over minutiae on insurance forms, labeling mistakes or clerical errors as fraud and fining/suspending licenses accordingly. There is currently very little risk for an attorney to go after physicians; the law favors "little lotto lawsuits" by rewarding attorneys who succeed, whistleblowers are rewarded for success but not penalized for failure, and the current laws regarding healthcare are flexible enough that almost anything can be construed to look like poor practice.

Is this book basically a 'scare story' that fooled me into thinking that this is a significant problem, or is there actually a risk of this sort of mindless legal battle occurring? Have practicing dentists out there been involved with, threatened by, or known someone involved with alleged "Insurance Fraud"?

Some 'secondary' questions...How meticulous is your record-keeping? Does Dental school teach you about maintaining records and general office upkeep, or is that something you learn on your own?

Thanks all.
