I think after they send in their quota they can only offer you a new spot, they would still have to offer the previous spots as planned. There is nothing stopping them from doing this I don't believe except the money to pay for you.
This is the last year of out of match spots from what I hear. Actually I am kind of glad. It is kind of unfair to the folks that have to go through the match. And, some programs put undo pressure on some people to go outside the match.
