Prescribing out of scope

What do you guys think about specialized MDS prescibing outside of their scope? An example would be an anesthesiologist prescribing birth controls?

How about dentists? I got 3 rx from a dentist today for medication such as Ambien. Personally, I think there should be serious consequences as that in my opinion is practicing medicine. . .

The other post asks if other people encounter HCP that prescribes outside of their scope. My post askes how do you guys FEEL about it. Do you think there should be any legal ramification, etc.
 
I think if you read through the posts a couple of things jump out:

  • What you feel has absolutely no bearing on your actions.
  • This activity is governed by the laws of the state in which you practice.
  • In most states it is illegal to prescribe outside of the scope of your practice.
What gets in the way is interpreting what is inside the scope of the practice:

Dentist prescribes Ambien. Is it ok?

  • Ambien 10 mg # 30 1 hs prn sleep not ok
  • Ambien 10 mg # 2 1 tablet 1 hour before procedure. Off label but legal.
A gynecologist who prescribes Phenergan w/Codeine. In PA it is OK as ALL gynecologists are MD's who have the right to prescribe whatever they want as long as they have examined the patient and keep medical records.

Again I think most of the issues were plowed over in the other thread. This is a legal issue only. Feelings don't count...

Since most issues have already been discussed on this board, how about we shut down posting rights and just have everyone search for their answer? How does that sound?

Don't be a jerk, O.K.. You should always search to see of the subject has been discussed recently as you get an immediate answer as opposed to waiting for others to weigh in.

In addition, after posting the link I suggested the OP post back if they had any additional questions. Do you have a problem with my response? I condensed the main issues that were discussed in the thread and expressed my view that emotions plays no real role in the issue.

Okay, maybe I was a bit harsh -- sorry. Sometimes I get tired of people just asking people to do a search on particular topics. If you ask a question on a different day, you can get different responses. That's all I wanted to say.
