I'm not a doctor, but question some "legal advice" from a psych in Illinois. I have children, 9 and 15, that are seeing a psychologist. I am divorced with joint custody. My exwife, due to court reasons, is trying to get any session notes and records from the psych pertaining to their sessions.
What are the patient privacy laws and rights pertaining to this? Can she legally demand from the psych to hand over the files? Can she do it if 1 of the kids signs off on it? Or, can it only happen with a court order?

SDN cannot offer professional advice, so the best thing to do is consult a lawyer and/or state psychology organization in whichever state that you reside, as laws can differ greatly and in such an important case you want to make sure you have all of the applicable
information.
