After looking through old threads and reading up on residency rules for North Carolina, I still find myself confused on whats gonna happen for me when I take a gap year and apply to med schools.
I am currently a junior from NC but studying OOS at a private school. I still currently have a NC license and am a dependent of my parents when filing taxes. In all official documents my permanent address is that of my parents house. I currently plan on taking a gap year so I will be applying right after graduation.

The above is NC's residency rules. I don't physically live in NC because I attend a school out of state even though my permanent address is in NC. The first question is: will I be considered a IS applicant when I apply right after graduation? I feel that it would be unfair to penalize someone and take away their state residency just because they are attending a school out of state!
The second question is if I spend the gap year outside of NC (say in the same state I currently am attending school in), IF I somehow get into a NC school, will I be paying OOS tuition because I will have not been living in the state for the past 12 months and will have gave up my residency?

- you established your domicile in North Carolina twelve months before the first day of classes for that term, and
- you have maintained that domicile for at least twelve continuous months.
- that you were physically present in the state,
- with the intent to make North Carolina your permanent home indefinitely, and
