But if you cut it that way, wouldn't you have a Cl on one side and H on the other?
 
Yes but it's in the same plane as the mirror, so it doesn't count. Whatever is in the same plane as the mirror don't get a reflection and this is important when finding the mirror plane. So you just need to compare CH3 on both side of the mirror.
