What are my chances for med school ??

I was recently suspended for violation of student code of conduct, specifically the gender based misconduct policy. In other words sexual assault. I am totally innocent but the way the law works, they found me guilty. It was a case of a girl protecting her relationship and reputation rather than admit she cheated. Anyways, I'm in my second year of undergrad and figuring out whether it is worth it to continue? Any advice, ideas, and opinions are welcome. Thanks.

Hate to be blunt but the way it sounds the chances are near impossible. If you say you are "innocent", did you try to appeal? No matter what the other person said, the law found you guilty for what was presented. Furthermore, you mention law and then school misconduct, did you also get tagged with a crime as well or just the school misconduct?

Either way it sounds like your chances are extremely low. But its in your best interest to obtain the advice of a lawyer and not SDN.

It only went through school, no law was involved and the student is not pressing further charges. Even if I kill my MCAT and have a killer GPA you don't think I have a chance to get into med school?

Professionalism and intellect are two different things ad coms consider. While everyone has had their fair share issues during life, it would be VERY hard to explain the circumstances you described. Even if you were to explain your story in the 500 character box on the application, what would you say? That the person was trying to save her reputation and what not rather than admitting she cheated?

I was at one point a student judge for the honor council at my university, and the process often gives a chance for you to appeal. I am sure you had your chance to appeal as well, in which you may have provided countering statements to mitigate your ideas. That said, please understand the medical profession involves touching patients for medicinal purposes and thus with this sort of cloud hanging over an applicant, I am not too confident any adcom will be able to let this go.

No. Suspension from school for sexual assault is basically a black hole you can't crawl out of.

Schools will not generally try to screw a student over without some kind of proof. He said/she said is generally NOT proof.

Schools don't operate based on "guilty until proven innocent." Why couldn't you appeal your case?

i did appeal, the basic law is that if the girl is intoxicated there is no possible way she can give consent no matter what, therefore, i was automatically found guilty for the get go

Confused, couldnt give consent, but after the fact she was protecting her reputation? I hate to be that person, but something doesnt add up, eitherway, if you feel you are innocent, please consult a lawyer at all costs, forget medicine for a moment, this your life reputation we are talking about....

Well, if that's the rule, then you can't really do anything about it. It kind of sucks, but it must have been listed somewhere in your student handbook...

Gotya, yeh that kind of sucks, eitherway, I strongly suggest you seek council, for now drop medicine, and seek to clear your name. This is your life you are trying to salvage.

it didn't go on my permanent record either, just on my transcript for 7 years thats it, so if i do get accepted to med school and make it through, i never have to worry about this pooping up ever again

I have to agree with this comment. Right now, medicine should be the last thing on your mind to be honest. This is very important and will not look good overall in the grand scheme of things regardless of the career you search. Find a council or a lawyer and really check out your options.

I am not at your university, but you need to understand that you need to go through the application process, pre-med health committee, and obtain LORs, I mean often times professors will want to look at your current record to ensure they are writing the LOR for the right reasons. I or anyone on here cant decide for you, but so far the general consensus is, "drop medicine for now and get your name cleared".

Get a lawyer, this is completely BS. I am a man, so if I'm completely intoxicated, then all the girls/soccer moms have sex with me while i'm drunk would be committing sexual harassment? That would be fantasy for all guys.

This story doesn't make any sense. You guys both kissed and then the next day, she what? Called the cops and claimed sexual assault? This story doesn't really make any sense what so ever. Anyways, the point is you have to clear up the situation. That is the most important thing.

we kissed, next day she went to school psychologist with her boyfriend because she felt "used" or that she had been taken advantage of, then they had an investigation and since she was drunk, it is labeled as sexual assault, i tried appealing, it didn't work. I talked to a lawyer and he said his grandson went through something similar and he couldn't even do much for him. Basically, anyone who has drank and kissed someone has been sexually assaulted or committed sexual assault based on NYS law

That just isn't how things work, and first you said it was just all through the school but now you are talking about "laws." Your story isn't adding up.

Tales of woe on SDN rarely have all the material facts, partly out of anonymity concerns, but mostly out of wanting people to wear the same rose-colored glasses.

I agree. No school will automatically suspend you for sexual assault just for kissing...

As I've said before, no school would put a student at risk and ruin his/her chances because of another student's say so. There has to be some court process. Also, kissing is vastly different than penetration. I would advise you to be extremely careful in the future.

Well, OP didn't tell us what he was kissing and how long. (In many states kissing is considered sexual contact only if the purpose is to gratify the sexual desire of either party, e.g. a goodnight kiss from your mom after tucking you in is not sexual contact.)

Agreed. OP very well might be innocent, but there's something missing in this story (also to preserve anonymity for everyone involved, that's probably a good thing).

Morale of the story for when people read this in the future: consent is super important.

Agreed. However to the OP, look the reality is, leaving out the story with us isn't going to change anything. Whether you tell us the truth or lie, or leave pieces out, people on this forum can't really help with much. The reality is the only thing you can do is seek legal counseling because in the end of the day, the only person who can help you is a lawyer.

thats is exactly what happened, look it up its NY state law. and the school follows laws with the hearing and what not, but ti doesnt have to necessarily go through the actual legal system unless the complainant chooses to go that route which she didnt

Did you initiate it or did she? If she initiated it, then her case would fall apart. If you initiated it, then I would say there is grounds to suspend you.
 
so the moral of the story is do not kiss anyone when you are at work, school or government building. At the club or home are ok

I would go even further and even say don't do it in the club, or someone you don't really know that well and not have a very close relationship with. NYS law does say that the intoxicated can not give consent, and you can be persecuted for sexual assault.

You never know what kind of person you meet out there. Best be cautious and don't do it.

Get a lawyer and another lawyer and another and if it has to go all the way to court to clear it up then fine. Things are different now as guilty until proven innocent rules in the media and due to political pressure at many universities, even when it comes out that the story was completely made up universities still are slow to reverse decisions. If it doesn't get to court then you are stuck with being guilty, right or wrong that is life!

As it stands you aren't getting into any med school I know of with this on your record. You will have to be honest about it on your med school app and lying has a likelihood of blowing up in your face even worse.

Last thing ANY school wants is to have a student kiss a patient and then it come out that the student had a sexual assault case prior to admittance. It's just not worth the risk of negative publicity.
