what should one do ??

Here is a case, I do not know how to respond..

My employer who I am working for the last 3 months for is laying me off because he found somebody for 15 k less per annum - in fact he offered me to accept this 15 k less and continue if I like-

Now he is refusing to pay for the first 5 weeks I worked for him- I joined in within 1 week after I moved from Australia( came for an interview 3 months prior and went back to oz) and my paper work was not ready when I commenced the job though my work permit was approved by INS.

So legally he does'nt have to pay for the 5 weeks However he acted as if he was going to pay until now.

I am leaving soon, the question is do I tell him off before I leave, I feel really awful, being used and betrayed- or is it just best to leave it without saying much, just in case I need to be in the same facility in the future.
 
Don't tell him off. The risk to your career by telling him off is worth far more then 5 weeks of salary. You probably won't even get your 5 weeks of salary back if you told him off anyways, so the only real benefit that you would receive by telling him off would be temporary peace of mind. Look at this way, if he has a conscience, maybe he will eventually feel guilty about it and remember how he feels guilty about it when one of your future employers calls and asks him for a reference regarding you.

Question... why continue to work? You aren't obligated to work for no pay... I would simply say to him, "Since you've made it clear that you do not intend to pay me, my last day was yesterday. Thanks for the opportunity and good luck with your new employee." 😉
 
scrubbs, you haven't got the whole picture- he is refusing to pay me for the first 5 wks in the three months.
