Would paying a medical office manager a commission for signing up patients violate any laws?

I am aware of anti kickback and starck laws. Would paying a referral fee violate the law if you are paying your office manager/marketing employee versus the actual source of the referrals?

I'm a little confused. How would an office manager be getting referrals in to you? By playing the role of a marketing person?

1. To motivate them more to sign up new patients when they call. 2. To motivate them more if I send them off marketing to local doctors/clinics

I would think being employed to do the job you're already paid to do to make new pt appts would be motivation enough, but it never seems to be enough these days.

No seriously, what are they doing with their time if they aren't setting up new pts that call?

I hear what everyone is saying, but someone in marketing would go that extra mile with commission, would not be much, $10 a patient perhaps. Just wondering it’s legal

That's not what I meant. I meant How is the office manager actually bringing referrals in? Are they calling other practices? Reaching out to the community? Or are they acting as a marketing capacity? What are they actually doing?

1. Eagerness to get ahold of referrals that don’t pickup, 2. Eagerness to convince those who are unsure to make an appointment, 3. Eagerness to convince someone to still get an evaluation when they are told this doctor does not rx Xanax, 4. Eagerness when they are reaching out to other practices to setup meetings for me, 5. Eagerness when interacting with our referral sources and other facilities, 6. And eagerness to reach out to other facilities for new referral sources if that becomes part of their duties

Bro this is psychiatry...shouldn’t you be like flooded with patients if you take insurance...? Are you in like a very saturated market?

Depends on what kind of population you are trying to recruit and how saturated your geographic area is. In my area, it's a little more competitive.
