This seemed to have slipped by and I did not notice anyone mention that the misleading practice assessment fee lawsuit that was thrown out in DC has resurfaced in the California courts.

In case anyone else cares, the APAPO lawsuit for the misleading practice assessment fee has been resurrected from the dead and is going to be moving forward after a reversal of the dismissal.

For the foregoing reasons, we affirm in part and reverse in part the district court’s orders. We reverse the dismissal of plaintiffs’ unjust enrichment claim and the denial of plaintiffs’ request to add a fraudulent inducement claim. We affirm the dismissal of the California-law claims as well as the denial of plaintiffs’ requests to add claims for rescission and negligent misrepresentation. For the negligent misrepresentation claim, however, we reverse to the extent that the dismissal was with prejudice. We remand for proceedings consistent with this opinion.

I can't imagine we will hear anything for at least a year. Now the plaintiffs can get back to the courtroom and the trial will probably take much longer than the time it takes for these decisions.
