Two main questions:

1. How does Stark III affect the setting up of a sleep lab. (And is Stark III in effect now?)

2. Can someone give a quick summary of the Stark laws and how they effect a sleep doc?

Stark has absolutely no effect on sleep labs, unless DME is involved.

Sleep labs are not a designated health service under the stark laws.

State and Federal anti-kickback laws still apply.
 
The new Stark Laws make it virtually impossible for a physician to dispense cpap to medicare patients. I guess a physician could still dispense cpap to non-medicare patients, but consult with a knowledgable attorney before trying this. The new regulatory environment makes it not worth it for sleep physicians to be be in the cpap business.
