AADSAS - arrested

Hi all.

I read other posts about this topic, but my situation is a little bit different. I was arrested and booked about 6 months ago for Disorderly Conduct (Class C Misdemeanor). I was in a packed bar (only had 3 beers about 5 hours earlier in the night so I obviously wasn't intoxicated) and the next thing I know 2 cops are pushing me out the door. I think they had mistaken me for someone else that may have bumped into them (like I said, bar was shoulder to shoulder packed), but who knows now. Anyways, I requested a field sobriety test, blood test, breathalyzer, etc. (you name it) and they refused to give me any PLUS, at the time, I wasn't even told what I was being arrested for and was put in the back of a squad car (with a dude arrested on drug charges) in front of a lot of people I know (pretty damn embarrassing). So, I spent the night in jail, which was horrible, especially stone cold sober. Long story short, I ended up getting the charge dismissed and expunged from state and local records (any charge stays permanently on your national record regardless if it was dismissed) and was only in the courtroom less than 10 minutes.

I don't know how (or if) to answer the last question on the background info "Are you currently under charge or have you ever been convicted of a felony or misdemeanor, other than minor traffic violations?"

The quick answer to these questions is no; however, the next sub-section to this question seems contradictory in regards to this. If yes, enter a brief explanation of the charge(s), the date(s) of the charge(s), current status, and outcomes.

"ADEA AADSAS requires you to report any convictions. You may also be required to report one or more of the following types of records directly to your designated dental school with details about the judgments or disciplines:
· Misdemeanor convictions
· Arrests for misdemeanors and felonies
· Adjudication withheld
· Nolo contendere
· Plea bargain"
What are your thoughts or suggestions? Thanks.

If your charges were dismissed and your records truly expunged then it was as if you were never arrested in the first place. Better damn well make sure that they were actually expunged (in some states you have to petition to have it expunged before it happens). Your best bet would be to call a lawyer in your area and find out. No one here on SDN has the correct answers for you.

My lawyer gave me a certified letter of expungement from the court; however, as I said earlier it will still appear on the Federal NCIC system records (as it will for anyone), but will not be on local and state records.

Call AADSAS and talk to them with your concerns; they would probably have a more suitable/reliable answer than SDN.
 
If your charges were dismissed, that means you were never convicted. I don't know why you would need an expungement if you were never convicted. In any case, it seems as though you don't have to report anything to AADSAS, but you might have to on secondaries. I know specifically that UCLA has a Personal History Form and that you have to report these kinds of things. If they specifically ask for arrests even without convictions, I would would put it down. Better to report and explain the situation rather than not report it and have them find out with a background check.
