I'm pretty sure in the US the first one's a freebie. 😕 They have to tell you they feel it's not appropriate (verbal warning) before it can be considered harrassment.
Sadly, no. In extreme cases (for example, smacking a co-worker's behind) you can be immediately terminated from your job and then it's up to the potential defendant to decide if that's enough punishment. I forget the exact terminology, but the basic idea is that you really should know better.
