Background Check (arrest vs detention)

Recently, I was pulled over for driving under the influence. Long story short, the officer handcuffed me and asked me a series of questions and performed some tests on me to determine my cognitive skills. At the end of test (breathalyzer), I blew a .05...The legal limit is .08. He released me, and told me that I was never arrested, but simply "detained for a few minutes, and then released". How will this affect my background check? I'm sure this detention will show up on the background check, but will it look just as bad as an arrest? Thanks for any input.

I am sure if you were just "detained" then it simply means a matter of possible criminal activity was being investigated. As per the law and the officer based on what you said it seems no law was broken and hence you were not "arrested". Will it come up on a background check? Why would it since no law was broken based on what you have said.

That said, I am not your mom or dad but consider yourself lucky nothing else happened because this was quite risky let alone negligent. Take it as a teaching point and move on. Im not a lawyer and most everyone on here isnt either so its in your best interest to consult a lawyer (usually for free) to see what they say. Even if a blip comes up on your app that isnt disclosed, that pretty much finishes your career.
 
It shouldn't pop up on a background check. BUT. It wouldn't hurt to go to the local district court, and follow-up to see if anything came up. I'm assuming you didn't get any ticket at all, rather, you simply cooperated and answered the officers questions.

Likely nothing was done other than it being logged in his paperwork. It shouldn't show on a background check unless you were charged. If worried the state dmv will have a record of it if anything was filed. You can request that for cheap from ur state.
