CA faxing over scripts for controls

Hi everyone,

I have another quick CPJE question (I have never worked in a CA pharmacy before). Can a prescriber fax over a script for a CIII-CV? I ask because CA law requires that the prescriber physically sign and date a hardcopy for all controls, so a faxed hardcopy would technically not qualify since it is not physically signed or dated by the MD on the copy that the pharmacy has. Am I correct in assuming that CS scripts cannot be faxed ever?

Why would a faxed prescription not be manually signed or dated by prescriber?

Because when it is faxed, it is but a copy of the signature and date, not the original signature and date in the prescriber's original handwriting.

Legally, i dont think you can accept faxes for controlled substance in California. You would have to call the prescriber and verify the prescription.

Can a prescriber call in or send a fax prescription for Schedule III – V controlled substances?

Yes. For prescriptions called in to the pharmacist, the pharmacist must reduce the prescription to hard copy form using a form of the pharmacy’s own design, and sign and date the prescription in ink. For faxed prescriptions, the pharmacist must produce the prescription in hard copy form, and sign and date the prescription in ink.

Note: One of the security features on the new tamper-resistant prescription forms will print “void” across the face of the security prescription when faxed or copied, prescribers are encouraged to use a regular prescription form when faxing prescriptions.

For those practicing in California, do you guys actually sign and date faxed prescriptions for controls? I know the law plainly states so, but I've never seen this in practice.

At WAGS they madd sure we did. CVS didn't even make techs write in addresses in my district til recently.
