Can I submit COMLEX and withhold USMLE?

This question has been addressed in a ancillary way in postings in years past but not exactly head-on.

Scenario:
Passed COMLEX Step 1 and USMLE Step 1.
Passed COMLEX Step 2 but failed USMLE Step 2 CK.

Desire:
Avoid retaking USMLE, rely on COMLEX.

Question:
As a D.O. student applying in the allopathic match for psychiatry, may I be utterly silent in the ERAS application about whether I took the USMLE, such that my USMLE scores do not appear in the application and the residency program sees only COMLEX scores and for all the program knows I only took COMLEX?
 
You must report your USMLE scores if you are applying to any ACGME programs.

From the ERAS instructions:

Note to osteopathic applicants only: Before you certify your ERAS application, consider whether you will apply to ACGME and/or AOA-accredited programs. If you apply to ACGME accredited programs and you have taken the USMLE, you must report that on your CAF. If you only apply to AOA accredited programs, you do not have to report the USMLE on your CAF.

Would this apply to these programs as well?
 
I did it. My COMLEX scores were better percentile-wise than my passing USMLE scores, so I stuck with COMLEX all the way, especially since I went primary care. On my interview trail no one ever asked about and I never mentioned my USMLE scores. I didn't know those ERAS semantics/rules and don't think any program or even ERAS or NRMP would be anal enough punish someone for ignorance of such a detail. Would you, aProgDirector?

I don't know anything about COMLEX scores, but how do you know your USMLE percentile? NBME does not report exact percentiles for USMLE scores.

You just filled in the information on ERAS and left out your USMLE score and matched without consequence?

Theoretically, not reporting your USMLE's is "fraud". However, I doubt anyone will ever notice or care.

Some schools include scores in the MSPE, however.
