Regarding the waiver, I think signing it just means you waive your "right" to see it. Based on that FERPA act or whatever, each applicant has a "right" to go and ask to see what their recs say, but if you waive it, the school doesn't have to comply.
So if your prof offers you to read the rec he/she wrote for you, that's definitely not violating the waiver. But, if you went to your school's career counseling center that gathers all your recs and demanded to see your recs, I think that would be.
I don't know about the May 15th/matriculation stuff...maybe it's that the rec is only confidential insofar as it has an effect on your application? And so it wouldn't matter after matriculation?
On a side note, I don't think I've ever used the word insofar before.
