COMLEX Step II CE June 1 date?

I want to get my written board scores back early and am trying to decide between the one June date (june 1st) or the two July dates (26,27). I think it's rediculous how limited the dates are but my question is will I be taking the test illegally if I take it June 1st because at my school our 4th year rotations don't start until June 12th when I assume we become (magically) 4th year students?

Do you have to technically be a 4th year to take step II?
