If you have an expunged misdemeanor (dui) and answered "no" to the question on your primary asking about criminal history (this was advice from lawyer). then in secondaries a specific school asks about charges not convictions and i think i would have to explain the charge but would this detail be shared with other schools that do not ask about charges? what if you are an applicant that highly stands out like a native american with a 524?

Schools do not talk to each other. They do talk to the app services.

A DUI is a relatively harmless IA. Just explain where needed, and own the transgression.

Really? that is the first time I have heard someone refer to a dui in that manner. from previous searches it seems like people think this will greatly reduce your chances of admission as there are enough qualified people without criminal history.

If the DUI were very recent, as opposed to when the applicant was 17 or 18, that would be a more negative factor.

Most of us were young and stupid once.

My lawyer has advised to not mention DUI but rather say VC3454 (made up). would this come up as not up front and it would it be better to just say DUI? does it look like I'm avoiding it or like i know what I'm talking about? my lawyer seems to think the latter but i have a suspicion adcoms would think I'm not taking it head on.

Did your lawyer get his law degree in a cereal box???

This is just asking the Admissions Dean to go investigate what this nonsense statute is.
