Not sure if this is the correct forum for this...
The law requires that consent for surgery must be given in a sober state, correct? If surgery is given to someone under the influence, the doctor can be sued for malpractice.
How does this apply if someone comes into the emergency room drunk, but they urgently require surgery?

Think about doing CPR on someone who collapsed on the sidewalk.... You don't need their consent because they can't give it.

Emergency physicians face decisions like this all the time. They could give a more exhaustive discussion on all the variables which must be considered.
