I have a patient treated with oral narcotics for cancer pain. They are apparently severely immunocompromised and requesting telemedicine visits. As I understand if I have seen patient in person initially this is an option however the Ryan Haight act is not crystal clear to me. I was planning on seeing in office every three months and telemedicine the months in between. I live in Texas. Is this legal? Should I call the DEA to double check this?

I practice in Texas. Its my understanding that you can do telemedicine visits and refill opioids so long as there are no medication changes. If you are planning on changing any opioid medications than they need to be seen in office.

Do you know how long you can go between visits for telemedicine refills?

This is all about documentation. You can get away with seeing the patient every 90 days and issuing prescriptions for those 90 days as long as the start dates match up with when they are supposed to fill the medicine. The telemedicine visits in between would appear only for profit.if the patient is at moderate or high risk, then they should be seen every month in the office low to moderate risk. They could probably get seen every three months or you could justify telemedicine visits in between office visits.

This is a simple thing but many don’t receive training on how to do this within the rules and safely. Thanks
