cvs dilemma

I work at a fairly busy cvs. We do about 3500 scripts a week. Recently we got fined by the state for having an incorrect ratio of techs. Also cvs recently lost a battle with the state regarding the designation of the person at drive thru. Cvs argued the drive thru person should be a pharmacy service associate. The state declared that since the drive thru attendant "prescans", the drive thru attendant has to be classified as a pharmacy tech and will count against the ratio. We can only have 2 techs for every pharmacist (3 techs if one is nationally certified). We only have one nationally certified tech on our staff. Our pharmacist overlap is only from 12 to 4. So after 4, we will only have 2 techs on. Currently we have 5 techs and 2 PSAs after 4. We asked our supervisor for more pharmacist hours to abide by the state ratio. Of course our request was declined. Our store did run smoothly, but moving forward it is impossible to do this many scripts without proper staffing. Seems like we are stuck between bureaucratic bull**** and corporate bull****. Has anyone dealt with this situation? If you work in a high volume store, how do you schedule the correct ratio of techs when you are understaffed rph hours?
 
Obviously the fine is treated as merely a cost of doing business like all the other BOP violations CVS has racked up all over the U.S. due to improper staffing (no PIC violations, tech ratio violations, improper counseling violations, etc., etc.). Hope it doesn't affect your license.
