Depends potentially on the state/circumstances surrounding the discovery. A place I worked at had a technician that failed to renew their license and was still working and functioning as a pharmacy tech. The PIC reported the violation voluntarily to the board and the pharmacy (no individual pharmacists) were fined, the tech was able to renew and continue working and was also not reprimanded by the board. Now, if an inspector came and asked to view permits/licenses and noticed people were working with expired licenses I think things would be a little more ugly, likely the pharmacy and PIC would get dinged in some way. I know another case where a technician who thought being licensed in a neighboring state was sufficient to work in another state within the tri-state area. The board noticed on an inspection that they did not have a permit in their state, the tech plead ignorance on the matter. The PIC was informally warned and the tech in question had to do clerk functions until their license was issued. No fines or no write ups in this case. Either way I don't think it's worth the risk, if they don't have a tech license they should solely function as a clerk or not be allowed to work in the pharmacy.
