So I'm taking a physiology class, and I let it slip that I was getting ready for the mcat next year. The instructor, who did an MD/PhD, gave me the accompanying test bank to our textbook, saying that since he was moving away at the end of term he didn't need it anymore, and it could be helpful test prep for both the mcat and subsequent physio courses.

In leafing through it after, i couldn't help but notice more than a couple questions from previous exams. Would it be wrong to keep the book? I would give it back, but some of these really resemble stuff in my kaplan bio book and I want all the practice I can get.

I should point out that the book itself has a notice on the back saying that it should not be shared with students, and I've my final with the same instructor on Monday.

What would you all do?

I would ask the professor if he/she intended to give this to me with the prep material/books. If yes, you'll have nothing to worry about, and if not, just give it back and they will appreciate the honesty.
 
It sounds as if your instructor gave you the book directly without the possibility of it being mixed in accidentally with other books. Is that correct? If so, I wouldn't worry about it. Don't look at it again until after Monday's final and there is no ethical issue. I suspect if your instructor gave it to you before the final that they didn't think it would give you any unfair advantage (i.e., most of the final exam questions are not from that book).
