Does anyone know where they address day supply limits for controlled substances in the Florida laws and regs? Is it true that they are in the process of changing or have changed the day supply limit for schedule II's?

I haven't heard anything. I only ever see scripts for a 30 day supply or less, anyway.

For C II prescriptions, there is no limit on days supply. The reason you most often see 30 day supplies is due to the constraints of insurance companies. If these constraints did not exist, the day supply would be for the period of time the prescriber thinks is reasonable for follow up.

As of last year, according to an inspector from the Florida Board of Pharmacy I talked to, it was acceptable to fill 90 day supply on CII medications now that the DEA allows it. This is more for patients on Ritalin, Adderall etc... and where I work at, this is common and some insurance companies cover it. (this is most notably seen with Caremark & Paid) C-III drugs you can fill only a 30 day supply. (like Vicodin, Lorcet, etc...)

893.04 2E Pharmacist and practitioner.--

"(e) A pharmacist may not dispense more than a 30-day supply of a controlled substance listed in Schedule III upon an oral prescription issued in this state."

thanks for the replies-that clears it up. My store was actually inspected yesterday by the Dept. of Health and I talked to the inspector
